By using the TamTami web site, a service by Zmok s.r.o. ("Zmok"), you are agreeing to be bound by the following terms and conditions (“Terms of Service”).

Basic Terms

1. You may not use the TamTami service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
2. Especially, you may not use the TamTami for publishing or retrieving content related to pornography, sexual practices and aids, arms and weapons, drugs and alike.
3. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links (“Content”) that you submit, post, and display on the TamTami service.
4. You must not modify, adapt or hack TamTami or modify another website so as to falsely imply that it is associated with TamTami.
5. You must not create or submit unwanted email to any TamTami members (“Spam”) or use TamTami in distributing such email.
6. You must not use TamTami to transmit any worms or viruses or any code of destructive nature.
7. You must not, in the use of TamTami, violate any laws in your jurisdiction (including but not limited to copyright laws).

Violation of any of these agreements will result in the termination of your TamTami account or other forms of banning you from using the service. While TamTami prohibits such conduct and content on its site, you understand and agree that TamTami cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the TamTami service at your own risk.

General Conditions

• Your use of the service is at your own risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. TamTami does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
• We reserve the right to modify or terminate the TamTami service for any reason, without notice at any time.
• We reserve the right to refuse service to anyone for any reason at any time.
• You expressly understand and agree that TamTami shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if TamTami has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
• Abuse or excessively frequent requests to TamTami may result in the temporary or permanent suspension of your access to TamTami. TamTami, in its sole discretion, will determine abuse or excessive usage of the API. TamTami will make a reasonable attempt via email to warn the account owner prior to suspension.
• We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
• You must not modify, adapt or hack the service or modify another website so as to falsely imply that it is associated with TamTami.
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any TamTami customer or member will result in immediate account termination.
• You understand that the technical processing and transmission of the service, including your content, may be transfered unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
• You must not upload, post, host, or transmit unsolicited email or “spam” messages.
• You must not transmit any worms or viruses or any code of a destructive nature.

Copyright (What's Yours is Yours)

• We claim no intellectual property rights over the content you provide to the TamTami service. Your account details and published contents remain yours. However, by publishing content to TamTami you agree to allow others to view and access your content.
• TamTami does not pre-screen the content, but TamTami and its designee have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the service.

Changes to these Terms of Service

We reserve the right to alter these Terms of Service at any time. If the alterations constitute a significant change to the Terms of Service, we will notify you via internet mail or by placing a prominent notice on our site. What constitutes a "significant change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
